Sexual Battery Definitions
Sexual battery is described in Ind. Code § 35-42-4-8 and is defined
as when "a person who, with intent to arouse or satisfy the person's
own sexual desires or the sexual desires of another person, touches another
person." In these cases, the victim must be "compelled to submit
to the touching by force or the imminent threat of force," or "so
mentally disabled or deficient that consent to the touching cannot be
given." This is considered a Class D felony.
This offense can be charged as a Class C felony if certain elements are present:
- If the threat of deadly force is used
- If a deadly weapon is present (and used to threaten)
- If the battery occurs to a victim who has been drugged
Both Class C and Class D felonies come with significant prison sentences.
