Know Your Rights

It is important that you know your rights, particularly in a drug crimes case. You have the right to remain free from any unreasonable search under Indiana law. If a search is done illegally, your attorney may be able to get a lesser charge or get the charges dismissed. This depends on the specifics of your case, but only an experienced Noblesville drug defense attorney like ours at The Criminal Defense Team will know the tactics to get this done successfully.

Drug Classifications

There are five drug classifications called schedules that are used in Indiana. The schedules are determined by how addictive the drugs are and can be used to determine charges and punishment.

The FIVE Schedules are:

  • Schedule I: The most dangerous drugs with high addiction rates and no legitimate medical use. This includes, but is not limited to, ecstasy and heroine.

  • Schedule II: These are drugs that have a high risk of abuse and addiction, but may have a legitimate medical use. This includes cocaine, codeine, PCP, and methamphetamines.

  • Schedule III: These drugs are less dangerous than the above but do have a risk of abuse. These include anabolic steroids and ketamine.

  • Schedule IV: These have a slight risk of abuse and are widely accepted in the medical field. These include Ambien, Xanax, and Valium.

  • Schedule V: These are the least severe and have a low risk of addiction and abuse. These include drugs like Robitussin AC.

The sentences for these charges vary between six months and three years in prison and up to $10,000 in fines. Because of the complicated nature of drug crimes in Indiana, you need to work with an attorney who will learn the details of your case and be able to fight for you. With more than 100 years of combined experience, the attorneys at The Criminal Defense Team will work to get you the best outcome possible. There are only six board certified attorneys in Indiana, and The Criminal Defense Team has five of them.

How Does Our Team Defend a Drug Case?

Our experience as dedicated criminal defense lawyers tells us that the best way to defend the charges is to learn everything we can about the facts of the case. We need to know every inch of video and audio evidence that often exists in drug cases and scrutinize it for holes in the case. If there is a confidential informant, we need to know who they are and what their motivations might be to lie. We may need to take their deposition to learn more about them and their motivations. We also need to understand all of the evidence in the larger context of the case. It is only then can we effectively advocate for our client by letting the prosecutor understand that we know our case better than they do. Our experience is that when prosecutors know that they are perhaps out-strategized on a case, and have a fear of losing, that then they may start to loosen up and begin to have a meaningful dialogue with a proper resolution in mind. Drug cases have their own style, language and strategy. We have a combined 90+ years of experience in drug cases from which we can draw. Often, we will utilize a game plan which combines strategies from previous cases that had similar facts. This is an unbelievably valuable tool for attaining success for our clients. We also have a former prosecutor on our team who can offer insights as to how a prosecutor might be thinking on a particular case or on a particular issue, and former support staff for judges who may be able to offer ideas as to how a judge might view a certain case or issue. Drug cases are on the rise. However the Criminal Defense Team has the aggressiveness, experience and personnel to put our clients in the best position to get the best result. Our reputation for winning at trial doesn’t hurt either.
